You have a good case. They can't call after 9pm. On a rare occasion- an auto dialer may call the wrong time zone at the wrong time- point out what time it is- they should apologize and hang up. If the debt is disputed, I would either mark it as such in the computer- so we stopped calling or ask the consumer to fax in a copy of the paid bill and then I would send it into the client, or if we owned the debt, file the paid receipt and close the account. If the collection agency is reputable, they have an entire department that oversees this- demand to speak to someone in Compliance. Not a supervisor- supervisors are often glorified collectors under a lot of pressure to hit a huge goal. No collector wants to be recorded refusing to connect someone to Compliance.
